“Life Changing Box” Rules and RegulationsOFFICIAL RULES NO PURCHASE NECESSARY TO ENTER OR WIN. THE “LIFE CHANGING BOX” INSTANT WIN GAME (THE “GAME”) IS OPEN TO FACEBOOK MEMBERS WHO ARE LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA 13 YEARS OF AGE OR OLDER AT TIME OF ENTRY. GAME begins AT 12:00:00 AM EST on june 12, 2008 and ends AT 11:59:59 PM ET ON july 14, 2008 (the "Entry Period"). GAME VOID IN PUERTO RICO, ALL OTHER U.S. TERRITORIES AND POSSESSIONS, OVERSEAS MILITARY INSTALLATIONS AND WHERE PROHIBITED. ELIGIBILITY: Game is open to Facebook members who are legal residents of the 50 United States and the District of Columbia, 13 years of age or older at time of entry. Employees and their immediate families (spouse, parents, children, siblings, and their respective spouses), including those living in the employees’ households of LOWE Worldwide (the “Sponsor”), Marden-Kane, Inc. (“Administrator”), and its respective parent companies, affiliates, subsidiaries, divisions, prize suppliers, advertising and promotion agencies, and any others involved in the creation, production or execution of the Game, are not eligible to enter or win a Prize. Void in Puerto Rico, all other U.S. territories and possessions, overseas military installations, and where prohibited. By entering, entrants agree to comply with these Official Rules. Game is subject to all applicable federal, state and local laws & regulations. United States law governs this Game. Void where prohibited. Entries received prior to or after Entry Period are void. TERMS & DEFINITIONS: Life Changing Box (“Box”) – is one of ten (10) “Virtual” Boxes available as of the beginning of the Entry Period that Participants will be competing to be in possession of at the time the Box opens to reveal a prize. Participant – a person who is a registered Facebook member and then registers and installs the Life Changing Box application and plays the game. Invitor Participant – is a Participant in the Game who sends an invitation to another Facebook member to participate in the game and that Facebook member installs the Game application onto their Facebook account. Invitee – is a person who is invited to participate in the Game by another Facebook member. Touch – a Touch is when you click on a Box to give you a chance to win the prize in the Box. Every Day of the Game (as defined below) you will receive 24 Touches into your account. Touches will not roll over from one day to the next any - unused Touches on a given day will expire at the end of that day. Application – is the program installed onto your Facebook account that will run the game through your Facebook account. You can invite friends to install the Application. In Possession of Box – you are in possession of a Box when you sign into your account and see one of the 10 Boxes in your account. Box in Game Play – is a Box that you have Touched for a chance to get Possession of, with the ultimate goal of Possessing the Box when it opens and reveals its prize. Game Account – is a running tally of your game participation. Keeping track of your Touches, Possessions, and hopefully, wins. Invite to Participate in the Game - an Invite is a Facebook message you receive from a friend, relative, co-worker, etc. with an established Facebook account that invites you to install the Game application onto your Facebook account and register for the Game. Day - A day is defined 12:00:00 AM EST – 11:59:59 PM EST. HOW TO ENTER/PLAY: Game Requirements: Participants and Invitees must have a Facebook account. You may create a Facebook account free of charge at www.facebook.com. How to Register/Participate in the Game: There are two ways to register for the game: 1.) Any time during the Entry Period go to www.facebook.com and click on the “Life Changing Box” Game icon; enter your date of birth and email address; install the game application to your Facebook account. 2.) Any time during the Entry Period you can/may receive a Facebook message from a friend, co-worker, relative, etc with an invitation to participate in the Game; open the email invitation and follow the instructions. You must have a Facebook account in order to participate in the Game. If you do not have a Facebook account you will be required to create one which you can do for free at www.facebook.com. How to Play the Game: Once you have registered for the game you will be shown up to ten (10) Life Changing Boxes (“Boxes”). Once Boxes have revealed their prizes, they are no longer available to Participants for Game Play. The date and time of a Box opening to reveal a prize is predetermined before the start of the Game at random by the Game computer. You will also be given 24 Touches in your Game account to use to Touch any or all of the Boxes. Each Day (as defined above in Terms & Definitions) you will receive 24 Touches into your account to use at your discretion (as defined above in Terms & Definitions). When shown the available Boxes you can Touch any or all of the Boxes to put such Box(es) in Game Play for your account. Once you have registered for the game and Touched the Boxes you want in Game Play in your account the Boxes will randomly move in and out of your account and into other Game Player Accounts. HOW TO WIN & CLAIM A PRIZE: If you are in possession of one of the ten (10) Life Changing Boxes on or after a winning Game play time, you win the prize indicated in that box, subject to verification. If you win, you will be told online how to claim your prize. You should print out a copy of your winning notification page and save it for your records. All prizes must be claimed by 7/25/08. Limit one prize per person/email account. A day is defined 12:00:00 AM EST – 11:59:59 PM EST. Winners will be asked to confirm their email address online. To claim a prize the winners will then be notified by e-mail within approximately 48 – 72 hours by the Game Administrator and will be required to complete, sign and return (or parent/legal guardian if winner is a minor in his/her state of residence) an Affidavit of Eligibility and Liability Release and, where legal, Publicity Release. If winner is a minor, the prize shall be awarded to the minor’s parent or legal guardian, who must execute the required documentation on the minor’s behalf in accordance with the time frame specified above. Completed documents must be returned within 10 days after issuance of prize notification or the prize will be forfeited and prize then awarded to Charity. If any letter/e-mail notification is returned as undeliverable, the prize will be forfeited and awarded to Charity. Prizes, other than the trips, will be shipped to the address indicated on the prize verification forms within 6 to 8 weeks after completed verification is received. If prize won by a person deemed a minor in his/her state of residence will be awarded in the name of a parent/legal guardian who must sign and return all required documentation as outlined herein. PRIZES AND ODDS OF WINNING: There are a total of Twenty (20) Prizes to be awarded during this Game. One (1) prize is awarded to the Participant who is in possession of a Box when it reveals the prize and one (1) duplicate prize will also be awarded to the Invitor Participant. ARV: $400.00 each. Total ARV of all prizes: $33,879.90. Winners of prizes valued at over $600 will receive a cash payment equal to 30% of the above stated ARV of the prize won to assist in payment of US taxes. All expenses relating to acceptance and use of prize that are not explicitly listed herein as being awarded, including payment of taxes, are responsibility of the winners. No substitution, barter, transfer, or assignment of prize permitted, except by Sponsor at its sole discretion. Sponsor reserves the right to substitute a prize of comparable or greater value if a prize or a portion of a prize is unavailable. Winners must meet all eligibility requirements as stated in the Eligibility section above or prize will be forfeited. Grand and First Prize winners are responsible for obtaining travel documents (such as a Passport for trip to Japan) as well as travel insurance (and all other forms of insurance) that they may wish to obtain (at their own expense) and hereby acknowledges that the Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. If a Grand or First Prize Participant Winner or Invitor Participant is under the age of 18 at the time of winning the prize, winner will be awarded the cash value of the prize in the name of their parent/legal guardian. If a winner is unable to participate in or accept the prize or any portion of the prize package for any reason, the Sponsor shall have no further obligation to the winner and prize will be donated to a charity of the Sponsors choice. Travel arrangements must be made through agent of Sponsor’s choosing. Travel must be completed within one year of being verification of winner eligibility. Actual value of the trip depends on winner’s residence or departure city. Specifics of prize package are subject to availability and Sponsor’s sole discretion. Complete terms and conditions of trip will be furnished with prize notification. Other restrictions and blackout dates may apply. Should a prize not be claimed by a winner, or a winner declines the prize, the value equal to the prize will be donated to a Charity selected by Sponsor. Odds of winning any prize are 1:3,911,350. Odds based upon an estimate of 78,227,000 total game plays transacted over the Promotion Period; actual odds of winning will depend upon the number of game plays transacted. CONDITIONS OF ENTRY: Entries becomes the property of the Sponsor (as defined below) and will not be acknowledged or returned. A potential winner is subject to verification of eligibility and compliance with all terms and conditions set forth in these Official Rules. An entry submitted through any other method is void. In case of a dispute as to the owner of an online entry, online entry will be deemed to have been submitted by the authorized account holder of the email address from which the entry is made. The authorized account holder is deemed as the natural person assigned to an e-mail address by an Internet access provider, service provider or other organization responsible for assigning email addresses or the domain associated with the submitted email address. A potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the email address associated with the winning entry. In the case of a minor, the potential winner’s parent or legal guardian may be the authorized account holder. If a dispute cannot be resolved, the entry will be deemed ineligible. Sponsor may, in its sole discretion, prohibit any Participant from using the Website or participating in the Game and refuse to award a prize if a Participant engages in any conduct Sponsor deems to be improper, unfair, detrimental, unsportsmanlike, or otherwise adverse to the operation of the Website, Game or other Participants. Such conduct includes, but is not limited to falsifying personal information required during registration, entry, or prize claim, supplying any information designed to circumvent any provision of these Official Rules, violating any term or condition stated herein, or obtaining a prize through methods such as automated computer scripts or any other programming techniques, allowing others to use Participant's personal information for the purpose of accumulating points or prize, or trying to defraud, reverse engineer, disassemble or otherwise tamper with the computer programs on the Website. Participants agree to return prize that they have won as a result of such conduct. By participating, Participants agree to these Official Rules and the decisions of the Sponsor and Administrator, which will be final in all matters with respects to the Game and the Prizes. ADDITIONAL TERMS AND RESTRICTIONS: Proof of play and/or winning will not be deemed to be proof of winning by Sponsor. In the event of a computer error, or if for any other reason, more Participants receive a winning message notice than the number of prizes stated herein, Sponsor reserves the right to award only the number of prizes stated in the Official Rules via a random drawing from among all eligible prize claims received toward the listed number of prizes. In no event will more prizes be awarded than those listed in the Official Rules. In the event of a game error, prize claimant releases Sponsor, their principals, agents & assigns, including Marden-Kane, Inc. from any claims, losses or damages that may result. Caution: Any attempt by an entrant or any other individual to deliberately damage any online service or web site, tamper with the submission process, or undermine the legitimate operation of the Game is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law. Failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If for any reason the Game is not capable of being executed as planned, or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, action of entrants, technical failures or any other causes beyond the control of Sponsor, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Game, Sponsor reserves the right at their sole discretion to disqualify any entry or Participant and to cancel, terminate, modify or suspend the Game and no prize will be awarded as Sponsor determines in their sole discretion. Notice of any cancellation, termination or modification will be posted on the Websites. Entries not complying with all rules are subject to disqualification. No correspondence regarding entries will be entered into with Participants. Sponsor shall have the right to modify, use, assign or dispose of such entries however they see fit without approval of Participants or any third party. Participants grant Sponsor the right to use their names, images, likenesses, photographs, voices and biographical materials, and submissions, for advertising, publicity and promotion purposes including posting the Entries online or any other purpose or on a winner’s list and other online announcements, and for sharing the Entries with the local press for viewing, whether TV or print, without additional compensation, unless prohibited by law. U.S. law governs the Game. DISPUTES: Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Participant and Sponsor in connection with the Game, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York. RELEASE: Neither Sponsor, nor its respective parent companies, affiliates, subsidiaries, divisions, prize suppliers, advertising and promotion agencies, including Marden-Kane, Inc., and their respective officers, directors, shareholders and employees (collectively “Releasees”) nor any telephone network or service providers are responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or web site, or any other error or malfunction, or any injury or damage to Participant’s or any other person’s computer related to or resulting from participation in this Game, or for any injury to person or property arising from the entrant’s participation in this Game or for the use or misuse of any prize won. Releasees are not responsible for lost, late, illegible or misdirected entries. Winners agree that the Releasees shall not be liable for any injury, loss, death or damage of any kind resulting from participation in this promotion or for acceptance and use of the prize awarded.
